1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and WEBCREATIONS IT SERVICES ("Webkreations", "we", "us", or "our"), a registered business entity in Malaysia. By accessing our website (webkreations.com) or utilizing any of our software, custom development, automation platforms (including Tapaubot, Comixpass, and API services), you agree to be bound by these Terms.

2. Scope of Services

Webkreations provides custom software engineering, automation bots, API integrations, web development, and cloud-hosted SaaS solutions. We reserve the right to modify, enhance, or temporarily suspend aspects of our services to conduct maintenance, upgrades, or security enhancements.

3. Account Registration & Security

When registering for our platforms or client portals, you agree to provide accurate, current, and complete information. You are solely responsible for maintaining the confidentiality of your credentials and API tokens. You must immediately notify Webkreations of any unauthorized use or security breach.

4. Fees, Payments & Subscriptions

All fees for bespoke development projects, service retainers, SaaS subscriptions, or digital usage credits are stated in Malaysian Ringgit (MYR) unless otherwise specified. Payments are securely processed via authorized payment gateway partners (such as HitPay, FPX, Credit/Debit Cards, and Touch 'n Go eWallet). By purchasing services or credit top-ups, you authorize our payment processors to charge your selected payment method.

5. Intellectual Property

All proprietary software, bots, algorithms, website designs, trademarks, and documentation developed by Webkreations remain the exclusive intellectual property of WEBCREATIONS IT SERVICES, unless explicitly transferred to the client via a separate written contract.

6. Limitation of Liability

To the maximum extent permitted under Malaysian law, Webkreations shall not be liable for any indirect, incidental, punitive, or consequential damages, including loss of data, loss of business revenue, or downtime resulting from third-party API platform changes (such as Shopee, Google, or e-commerce marketplaces).

7. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Malaysia.
